It's written for a California-based, US-only Shopify store using Klaviyo (email/SMS) and the Meta/Instagram Pixel, based on what you've told me. 1. Introduction
This Privacy Policy explains how Still Earth ("Still Earth," "we," "us," or "our") collects, uses, shares, and protects information when you visit thestillearth.com (the "Site"), make a purchase, or sign up for our email or text (SMS) marketing.
By using the Site or providing us your information, you agree to the practices described in this Privacy Policy. This policy should be read together with our Terms of Service.
2. Information We Collect
Information you give us directly:
- Name, email address, phone number, shipping and billing address, when you place an order, create an account, or sign up for email/SMS marketing.
- Payment information when you check out. We do not store your full payment card details — these are processed securely by Shopify Payments, our payment processor. See Shopify's privacy policy for how they handle payment data.
- Any information you send us directly, such as through email, our contact form, or Instagram DMs.
Information collected automatically:
- Device and usage information (IP address, browser type, pages viewed, time on site, referring URL) collected via cookies and similar technologies when you browse the Site.
- Shopify's built-in analytics, which help us understand site traffic and performance.
- Information collected via the Meta (Facebook/Instagram) Pixel installed on our Site, which helps us measure ad performance and show you relevant Still Earth ads on Meta platforms. This may include pages you viewed, products you interacted with, and general device information.
Information from your marketing opt-ins:
- Email address, submitted when you sign up for our newsletter or marketing emails (via a sign-up form, footer, or checkout).
- Phone number, submitted when you opt in to text marketing, along with your consent record and opt-in timestamp.
3. How We Use Your Information
We use the information we collect to:
- Process and fulfill your orders, and communicate with you about them (order confirmations, shipping updates, customer service).
- Send you marketing emails and text messages, if you've opted in, including promotions, product updates, and brand content.
- Improve and personalize the Site and your shopping experience.
- Show you relevant ads on Meta/Instagram based on your activity on our Site (if you have not opted out — see Section 7).
- Detect and prevent fraud, and comply with legal obligations.
We do not use your information to make automated decisions that produce legal or similarly significant effects on you.
4. Email & Text (SMS) Marketing
We use Klaviyo to manage and send our email and SMS marketing. When you opt in:
- Your email address and/or phone number, along with your consent status and sign-up source, is stored in Klaviyo on our behalf.
- We only send marketing emails or texts to people who have affirmatively opted in, consistent with our [Terms of Service].
- You can unsubscribe from marketing emails at any time using the link in any email, and from text messages by replying STOP, as described in our Terms of Service.
- Your phone number is not shared with third parties for their own marketing purposes.
5. Cookies & Tracking Technologies
We use cookies and similar technologies (like the Meta Pixel) to operate the Site, remember your cart and preferences, understand how visitors use the Site, and show you relevant ads.
You can control cookies through your browser settings, including blocking or deleting them. Note that blocking some cookies may affect Site functionality (like your cart). You can also opt out of interest-based Meta advertising directly through your Meta Ad Preferences or through the Digital Advertising Alliance's opt-out tool.
6. How We Share Your Information
We do not sell your personal information to third parties for cash. We share information only as follows:
- Service providers who help us run our business, including Shopify (our e-commerce platform), Shopify Payments (payment processing), Klaviyo (email/SMS marketing), and Meta (advertising). These providers are only permitted to use your information to provide services to us.
- Legal reasons, if required to comply with a law, subpoena, or legal process, or to protect the rights, property, or safety of Still Earth, our customers, or others.
- Business transfers, if Still Earth is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.
Sharing information with an advertising partner like Meta for interest-based advertising may be considered a "sale" or "share" of personal information under California law (see Section 7), even though no money changes hands.
7. Your California Privacy Rights
If you are a California resident, you may have the following rights under the California Consumer Privacy Act (CCPA), as amended:
- Right to know what personal information we have collected, used, and shared about you.
- Right to delete personal information we've collected from you, subject to certain exceptions.
- Right to correct inaccurate personal information.
- Right to opt out of the "sale" or "sharing" of your personal information, including for cross-context behavioral advertising (such as the Meta Pixel described above).
- Right to non-discrimination for exercising any of these rights.

Do Not Sell or Share My Personal Information: You can opt out of our use of the Meta Pixel for advertising purposes by adjusting your Meta Ad Preferences or using a browser-level opt-out signal (like Global Privacy Control), where supported. 8. Data Retention
We retain your information for as long as necessary to fulfill the purposes described in this policy, such as maintaining your order history, complying with tax and accounting obligations, and honoring your marketing preferences. If you unsubscribe from marketing, we retain a record of your opt-out so we can honor it going forward.
9. Children's Privacy
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us at thestillearthco@gmail.com and we will delete it.
10. Data Security
We use commercially reasonable measures, including those provided by Shopify's platform-level security, to protect your information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
