These Terms of Service ("Terms") are a legal agreement between you ("you" or "customer") and Still Earth ("Still Earth," "we," "us," or "our"), governing your use of thestillearth.com (the "Site") and any products, content, or communications — including email and text message (SMS) marketing — that Still Earth provides to you.

By using the Site, placing an order, or opting in to receive marketing emails or texts from us, you agree to these Terms. If you do not agree, please do not use the Site or opt in to our marketing communications.

All content on the Site — including text, graphics, logos, product photography, and the Still Earth name and branding — is the property of Still Earth or its licensors and is protected by copyright and trademark law. You may not copy, reproduce, distribute, or create derivative works from Site content without our written permission.

4. Products & Orders

• All product descriptions, ingredients, and pricing are accurate to the best of our knowledge as of the date posted, but are subject to change without notice.
• We reserve the right to limit quantities, refuse or cancel any order, and correct pricing or listing errors, including after an order has been submitted.
• Still Earth's magnesium oil spray is a cosmetic wellness product. It is not intended to diagnose, treat, cure, or prevent any disease. Consult a healthcare provider with questions about a medical condition, pregnancy, or before starting any new topical product.

5. Marketing Communications — Email & Text (SMS)

By providing your email address or phone number to Still Earth — through our website, a sign-up form, checkout, or in person — and affirmatively opting in, you consent to receive marketing communications from Still Earth as described below. You may opt in to email, SMS, or both, and each is governed separately.

5.1 Email Marketing

• By signing up for our email list, you consent to receive marketing emails from Still Earth, including product updates, promotions, and brand content, at the email address you provide.
• Every marketing email will include a clear way to unsubscribe (an "unsubscribe" link). You may opt out at any time by clicking that link or emailing us at thestillearthco@gmail.com with "unsubscribe" in the subject line.
• We honor unsubscribe requests promptly and in accordance with the CAN-SPAM Act. Transactional emails (such as order confirmations or shipping notices) are not marketing emails and are not covered by a marketing unsubscribe.

5.2 Text Message (SMS) Marketing

• By providing your phone number and checking the applicable opt-in box, you agree to receive recurring automated marketing text messages (including cart reminders, promotions, and product updates) from Still Earth at the phone number provided. Consent to receive texts is not a condition of any purchase.
• Message frequency varies. Message and data rates may apply.
• Reply HELP for help. Reply STOP at any time to cancel and opt out of further text messages. After you text STOP, we will send one final message confirming your unsubscribe, then no further messages will be sent unless you opt back in.
• Carriers are not liable for delayed or undelivered messages.
• We use Klayvio to send text messages. Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.
• Supported carriers may change at any time, and Still Earth and its SMS provider are not liable for delays or failures in message delivery.

5.3 Your Consent Is Separate for Each Channel

Opting in to text messages does not opt you in to emails, and opting in to emails does not opt you in to text messages. You may withdraw consent from one channel while remaining subscribed to the other.

6. Privacy

Our Privacy Policy describes how we collect, use, and protect your personal information. By using this Site or opting in to our marketing communications, you also agree to our Privacy Policy

7. Disclaimers & Limitation of Liability

• The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied.
• To the fullest extent permitted by law, Still Earth is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, our products, or our marketing communications.
• Nothing in these Terms limits any liability that cannot be limited under applicable law.

8. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any disputes arising under these Terms will be resolved in the state or federal courts located in California, and you consent to jurisdiction there.

9. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page with a new Effective Date. Material changes to our marketing/SMS terms will, where required by law, also be communicated to existing subscribers.
